Welcome to Mongoo LLC (“Mongoo,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of Mongoo’s consumer services, including our mobile application, website, and any channels of communication (collectively, the “Services”).
By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Separate agreements may apply to vendors, merchants, and delivery partners.
Minimum Age: You must be at least 13 years old to use the Services.
Minors (13–17): If you are between 13 and 17 years old, you may only use the Services with the consent and supervision of a parent or legal guardian. That parent or guardian is responsible for your use of the Services and agrees to these Terms on your behalf.
Account Security: You are responsible for keeping your account credentials confidential. You are responsible for all activities that occur under your account.
Accuracy of Information: You agree to provide accurate and complete information when creating your account and updating your profile.
Mongoo is a technology platform that connects consumers with third-party vendors (restaurants, grocery stores, retailers) and independent delivery partners.
Vendor Relationship: When you place an order, you are purchasing directly from the vendor. Mongoo is not the seller of goods.
Delivery Partners: Deliveries are completed by independent contractors or vendors’ own staff. Mongoo does not control their actions and is not responsible for their conduct.
License: Subject to these Terms, Mongoo grants you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial use.
Order Placement: By placing an order, you agree to pay all applicable charges, including product prices, delivery fees, service fees, and taxes.
Payment Authorization: You authorize Mongoo and its third-party payment providers to charge your selected payment method.
Errors: If there are errors in pricing, descriptions, or availability, we reserve the right to cancel or adjust orders.
Refunds: Refunds or credits are provided at Mongoo’s discretion, consistent with our Refund Policy.
Fees: Delivery fees, service fees, taxes, and optional tips may apply. All fees are disclosed at checkout.
Dynamic Pricing: Prices and fees may change depending on location, time, or demand.
Promotions: Mongoo may offer promotions, referral rewards, or credits. These are subject to expiration, withdrawal, or cancellation at our discretion.
You agree that you will not:
Use the Services for unlawful purposes.
Provide false, misleading, or fraudulent information.
Interfere with or disrupt the Services or networks connected to them.
Attempt to gain unauthorized access to accounts, systems, or data.
Harass or abuse vendors, delivery partners, or other users.
Mongoo may suspend or terminate your account if you violate these obligations.
Your Content: You may submit reviews, ratings, or photos. By doing so, you grant Mongoo a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with the Services.
Prohibited Content: You may not post unlawful, offensive, or misleading material.
Feedback: Suggestions and ideas you provide to Mongoo may be used freely without obligation to you.
The Services, including all logos, trademarks, text, graphics, and software, are owned by Mongoo or its licensors. Except as permitted under these Terms, you may not copy, distribute, or create derivative works without prior written consent.
Our Services may link to or integrate with third-party websites, apps, or services. Mongoo is not responsible for third-party services, their content, or their practices.
The Services are provided “as is” and “as available.” Mongoo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee:
The accuracy of vendor menus or product information.
That deliveries will arrive on time or without error.
That the Services will always be available or free from interruptions.
To the fullest extent permitted by law:
Mongoo is not liable for indirect, incidental, special, consequential, or punitive damages.
Mongoo’s total liability for any claims arising out of or relating to the Services is limited to the greater of:
(a) the amount you paid Mongoo in the 12 months prior to the claim, or
(b) $100.
You agree to indemnify, defend, and hold harmless Mongoo LLC, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses arising from:
Your use of the Services.
Your violation of these Terms.
Your infringement of third-party rights.
Agreement to Arbitrate: Any dispute arising under these Terms will be resolved by binding arbitration on an individual basis, not in court, except that you may bring qualifying small claims in small claims court.
Class Action Waiver: You agree not to participate in class actions or representative proceedings against Mongoo.
Opt-Out: You may opt out of arbitration within 30 days of creating your account by emailing legal@mongoo.app with your name, address, and a clear statement that you do not agree to arbitration.
Mongoo may suspend or terminate your account or access to the Services at any time for violations of these Terms, suspected fraud, or unlawful conduct. You may delete your account at any time through the app or by contacting support.
These Terms are governed by the laws of the United States and the state where you reside, without regard to conflicts of law.
We may update these Terms from time to time. The “Last Updated” date at the top reflects the latest version. Continued use of the Services means you accept the updated Terms.
